Gideon v. Wainwright was a landmark Supreme Court decision. The Supreme Court ruled unanimously that states are required to provide an attorney to defendants in criminal cases if they can not afford their own ones. The Court based its opinion on the Sixth Amendment of the Constitution.
Clarence Gideon was accused of minor burglary in a Pool Room in Florida and arrested on accusation only. He was too poor to afford an attorney and was denied one by the Florida judge. He was sentenced to five years in prison.
Gideon appealed to the Supreme Court while being in prison. He argued that he had been denied an attorney which was a violation of his rights under the 6th Amendment. The Supreme Court assigned Gideon an attorney and he received a new trial.
